With the consent of learned counsel for the parties, the matter is finally heard.

In a maintenance proceeding under Section 125 of the Cr.P.C. Initiated by non-applicant herein, Family Court after full fledged trial finding relationship of the husband & wife established; the non-applicant herein residing separately on account of sufficient cause; further finding that she is unable to maintain herself; applicant getting pension of Rs.11,000/- per month and having agricultural land, granted Rs. 1,000/- per month to the nonapplicant herein, which is sought to be challenged. 3.

Having heard learned counsel appearing for the parties and since the relationship husband and wife between parties is established; applicant is

admittedly getting pension monthly Rs.11,000/-; having agricultural land and non-applicant is aged woman having unable to maintain herself, the Family Court has rightly granted maintenance of Rs.1,000/- per month to the nonapplicant, I do not consider to be a fit case for interfering the amount of maintenance granted by the Family Court.

Accordingly, criminal revision is dismissed.
