1. This is first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 200 of 2018 registered at Police Station Kotwali, District Korba (CG), for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Case of the prosecution is that on 25.3.2018 the applicant was found is conscious possession of 4 kg and 978 gm of contraband article Ganja kept in a bag while he was going on his Motorcycle to sell it in village Manikpur.
3. Learned counsel appearing for the applicant would submit that the applicant is innocent person and he has been falsely implicated in this case. He is in jail since 25.3.2018. Charge sheet has not been yet filed and trial may take some time for its final disposal, therefore, the applicant may be released on bail.
4. On the other hand, learned State counsel opposes the application for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Taking into consideration the fact that the applicant is local resident of district Raigarh and there shall be no difficulty in his availability during trial and the trial of the case may take some time, I am of the opinion that present is a fit case to release the applicant on bail.
7. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and it is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one local surety in the like amount to the satisfaction of the concerned trial Court. He shall appear before the trial Court regularly on each and every date, unless exempted from appearance.
