Heard the contempt petition filed under Article 215 of the Constitution of India read with Sections 10 & 12 of the Contempt of Court Act.

Non compliance of order dated 08.02.2019 passed by this Court in WPS No.3829/2008 is the subject matter of the present contempt petition.

It is submitted on behalf of the respondents that Writ Appeals No. 261/2019 & 346/2019 are pending, therefore, any order which shall be passed in those writ appeals will be binding on both sides and order of the Single Bench shall be merged with order of the writ appeal, therefore, present contempt petition is not maintainable.

In view of the above, no further proceedings can be pursued in respect of the order of this Court passed by the Single Bench. The proceedings stand closed without prejudice to the rights and liberty of the petitioner as and when the appeal is decided.
