1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.21/2020 registered in Police Station Shankargtarh, District Balrampur-Ramanujganj for offence under Section 363, 366 & 376 (2) (<) of the IPC and Section 3/4 & 5/6 of the POCSO Act, 2012.

2. Prosecutrix aged about 16 years & 8 months has stated in her case diary statement that she was acquainted with the applicant and

they had love affair. They eloped on 9.3.2020 and stayed together till 23.4.2020 in the house of one friend of the applicant. At this place, the applicant committed forcible sexual intercourse on promise to marry.

3. Considering prior love affair and for the fact that the applicant is in jail since 23.4.2020 and charge sheet has already been filed, this Court is inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
