1. Heard.

2. By order dated 14.8.2017, the petitioner has been transferred from Government College, Ratanpur, District Bilaspur to Paluram Dhana College, Raigarh.

3. Vide interim order dated 04.09.2017, this Court has already stayed the effect and operation of the impugned transfer order.

4. Considering the fact that the petitioner is due to attain the age of superannuation in June 2019 and all other obtaining facts, it is deemed appropriate that the State Government should consider the petitioner's representation against the impugned transfer order.

5. Accordingly, the writ petition is disposed of with direction that in the event, the petitioner prefers a representation before the competent authority within a period of 04 weeks from today, the said authority shall consider the representation objectively and decide the same by a speaking order at the earliest.

6. Till the representation of the petitioner is decided, the interim order dated 4.9.2017 passed by this Court shall continue.

7. It is made clear that this Court has not expressed any opinion on the merits of the case and the petitioner's representation shall be decided strictly in accordance with law without treating any observations made in this order as opinion on the merits of the case.
