Versus

State Of Chhattisgarh Through The S.H.O. Police Station Jainagar, District Surajpur Chhattisgarh., District : Surajpur, Chhattisgarh ---- Respondent For Applicant :

Shri Gyan Prakash Shukla, Advocate For State :

Shri Samir Uraon, Govt. Advocate S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 05/11/2020 Heard.

1. The applicant is arrested in connection with Crime No.353/2018 registered in Police Station - Jainagar, District- Surajpur (CG) for alleged commission of offence under Sections 302, 201, 120-B, 34 IPC.

2. This application for grant of bail has been made by the applicant both on merits as well as on the ground of inordinate delay in conclusion of trial. According to learned counsel for the applicant, though, the trial was concluded and the case was listed on 5.2.2020 for delivery of judgment, prosecution moved application under Section 311 Cr.P.C. which was allowed and thus two more witnesses have been permitted to be examined, but thereafter, trial has not proceeded.

3. Considering that present is a case of commission of offence under Section

-2302 IPC, at this stage, I am not inclined to grant bail considering that only two witnesses are to be examined.

4. Let the trial Court expeditiously conclude the trial within a period of two months. In case, trial is not completed within two months, applicant would be at liberty to revive the application.

5. The application is accordingly rejected at this stage. Sd/-/-/--/------ (Manindra Mohan Shrivastava) Judge Praveen
