Hon'ble Shri Justice P. Sam Koshy Order on Board 29/07/2021
1. The grievance of the petitioner seems to be the inaction on the part of the respondents in not granting of the First Time Pay-scale which the petitioner is entitled for on completion of 10 years of service on a particular post.
2. According to the Counsel for the petitioner, the petitioner in the instant case has already retired from service on 31.05.2021. Before his retirement itself the Principal where the petitioner was
-2discharging his duty vide Annexure P/2, had forwarded the claim of the petitioner for grant of the First Time Bound Pay-scale. Vide his correspondence dated 18.09.2020, however there has been no further development on the same and in the process the settlement and finalization of the pension payable to the petitioner has not been properly finalized.
3. Given the limited grievance that the petitioner has and the fact that matter is pending consideration before office of the concerned District Education Officer, further the claim of the petitioner being one which has to be decided on due verification of the records so far as his entitlement part is concerned, this Court is of the opinion that the writ petition at this juncture can be disposed of directing the respondents No. 2 to 4 to immediately process the claim of the petitioner so far as his claim for first time bound pay-scale that he has entitled for on completion of 10 years of service in-terms-of the proposal sent by the respondents No. 5 to respondent No. 4. Let an appropriate decision be taken at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
4. The writ petition according stands disposed of. Sd/- (P. Sam Koshy) Judge J-
