1. The matter is heard through Video Conferencing.

2. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.110/2021 registered at Police Station Nevai, District Durg, C.G. for the offence punishable under Sections 457, 380, 34 of Indian Penal Code.

3. Learned counsel for the applicant submits that Court below has already granted bail to the co-accused in this case and, therefore, he seeks to withdraw the present bail application with liberty to file an application for grant of bail before the

Court below.

4. In view of above, the instant bail application is dismissed as withdrawn with the aforesaid liberty.
