This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.330/2018 registered at Police Station Mandir Hasoud, District Raipur for the offence punishable under Section 420 of Indian Penal Code.

The first bail application of the applicant was rejected on merits by this Court vide order dated 18.02.2019 passed in M.Cr.C. No.27/2019. 3.

Case of the prosecution, in brief is that the applicant had obtained Rs.10,50,000/- from the complainants Ramchandra Soni, Laxminarayan Soni, Ashok Dewangan, Nitesh Agrawani assured that he will provide job to them in Irrigation Department. Thereafter, he did not provide the job to the complainants. He had given a cheque to complainant Ramchandra Soni for a sum of Rs.9 lakhs, which was dishonored on account of insufficient fund.

Counsel for the applicant submitted that no investigation regarding Annexure A-3, which is a part of bail application has been done by Investigating Officer. The applicant is in jail since 19.10.2018 and a such the applicant may be released on bail.

On the other hand, counsel for the State opposed the bail application.

Looking to the above mentioned facts and circumstances of the case and looking to this fact that there is no change in the circumstances of the case on the strength of which the applicant be released on bail in the second round of litigation. Consequently, the second bail application is rejected.
