The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.27/2020, registered at Police Station Antagarh, District U. B. Kanker (C.G.) for the offence punishable under Sections 376, 376 (2) (n), 376 (3) & 506 of the IPC and Sections 5 (Tha) & 6 of the POCSO Act.

The prosecutrix was less than 16 years of age on the date of incident. The applicant committed forcible sexual intercourse, due to which she became pregnant and later on aborted.

Considering the age of the prosecutrix, no case for grant of bail is made out.
