1. The counsel for the petitioner orally prays for necessary amendment in the writ petition to the extent that inadvertently in paragraphs-8.2 and 8.3 of the writ petition, the deceased-Ashish Kumar Bhaskar has been reflected as father of the petitioner whereas, he is Brother of the petitioner.

2. The oral prayer is not opposed by the respondents. Accordingly, let necessary amendment be carried out during the course of the day itself.

3. The claim of the petitioner is for grant of appropriate relief for grant of compassionate appointment to the petitioner.

-24. According to the petitioner, his brother late Ashish Kumar Bhaskar was working as Assistant Teacher with the respondents who died in harness on 25.07.2014. Immediately thereafter the petitioner had moved an application for compassionate appointment claiming himself to be dependent on the deceased brother. The claim of the petitioner is till date not decided.

According to the petitioner, initially he was granted a letter by the department directing him to obtain qualification that is required for appointment to the post of Shiksha Karmi as per the scheme for compassionate appointment. However, the petitioner responded and submitted that since he is Class-8 passed, he be given compassionate appointment commensurate to the qualification that he has and the petitioner was ready to accept compassionate appointment on a lower post i.e. in the Class-IV category also. However, there is no further development on the said letter which was forwarded by the department to the higher authorities for consideration.

6. Given the aforesaid facts and circumstances of the case, let the respondent No.3 take an appropriate decision at the earliest on the claim of the petitioner and an appropriate order be passed within a period of three months from the date of receipt of copy of this order.
