1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 20.06.2021 in connection with Crime No. 239/2021 registered in Police Station- Kotwali, District Rajnandgaon (CG) for the offence punishable under Sections 457, 380/34 of IPC.

2. Shri Alok Sahu, Sub-Inspector, Police Station City Kotwali, Rajnandgaon, is present in person before this Court. He explained the 05 criminal antecedents of the applicant of similar nature of the years 2020-2021.

3. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

4. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
