For Non-Applicant : Smt. Fouzia Mirza, Additional AG. Proceeding Through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 02/11/2020 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.32/2020 registered in Police Station Pasta, District Balrampur-Ramanujganj for offence under Section 450, 376 and 506-B of the IPC.

2. The prosecutrix aged about 30 years was alone in her house at about 9 pm on 19.5.2020 when her family members had gone to attend the engagement ceremony in the house of some villager.

3. As per the statement of the prosecutrix, it appears, when the applicant

was present in her house, her husband reached and saw the applicant running away from the place of occurrence. FIR was lodged after 3 days i.e. on 22.5.2020.

4. Considering the entire fact situation of the case and for the fact that the applicant is in jail since 23.7.2020 and charge sheet has already been filed, this Court is inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
