The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.31/2018 registered in Police Station Kabir Nagar, District Raipur (C.G.) for offence punishable under section 376 of IPC.

As per the prosecution case, on 17/02/2018 the applicant allured the prosecutrix who was earlier friend and took her to RDA colony and forcefully committed rape. Thereby offence has been committed. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and the prosecutrix went alongwith the applicant on the alleged date of incident and they were known to each other and subsequently some altercation took place and report was made, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the prosecutrix which shows that she was earlier known to the applicant. Perused the report. Considering the statement and also the fact that charge sheet has been filed, without

further observation on the merits, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
