1. The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.148/2020 registered in Police Station Nagarnaar, District Bastar C.G. for the offence punishable under Section 20(b)ii(c) of the NDPS Act.

2. Earlier, the first bail application was dismissed for non-compliance of the Court order dated 08.12.2020.

3. The present applicant along with four other accused persons were traveling from Orrisa to Uttar Pradesh in a Scorpio car carrying

MCRC No. 5217 of 2021 100 kg of Cannabis (ganja) when they were intercepted at Amaguda Chowk at NH63. While the present applicant along with co-accused Mohammed Iklakh and Acchelal Verma were arrested, two other accused managed to abscond.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Admittedly, two other co-accused persons namely; Mohammed Iklakh Siddiqui and Acchelal Verma have been allowed bail by a common order in MCRC No.4034/2021 and MCRC No.2394/2021.

6. Considering that the present applicant is also in jail since 14.9.2020, the same period for which the released accused persons were in jail, I am inclined to release the present applicant on bail.

7. Accordingly, the second bail application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
