1. This Court by order dated 21.7.2017 in WPC No.1075 of 2016 directed the Deputy Director (Agriculture) to consider the petitioner's application for renewal of fertilizer license.
2. The said application has not been considered by the Deputy Director (Agriculture) as per direction of this Court and the impugned order has been passed directing the petitioner to file fresh application for grant of fertilizer license, which is contrary to the order dated 21.7.2017, whereas the said authority was required to consider the application for renewal of fertilizer license.
3. Accordingly, the impugned order is set aside. The Deputy
Director (Agriculture), Balodabazaar-Bhatapara is directed to consider the application of the petitioner for renewal of fertilizer license strictly in accordance with law within a period of 30 days from the date of receipt of copy of this order.
4. The writ petition is allowed to the extent indicated hereinabove. No cost(s).
