1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.65/2020 registered in Police Station Vaishali Nagar, District Durg, C.G. for the offence punishable under Sections 354, 376, 511 of the I.P.C. and Section 14(4) of the Protection of Children from Sexual Offences Act, 2012.

3. In the FIR, the prosecutrix alleged commission of aggravated sexual assault but in subsequent statements she diluted the version but has not denied the incident.

4. Considering the fact that the prosecutrix is aged about 07 years only, I am not inclined to release the applicant on bail at this stage.

5. Accordingly, the bail application is rejected, however, liberty is reserved in favour of the applicant to revive the prayer after examination of the prosecutrix.
