The main ground of challenge to the transfer of the petitioner is that the petitioner is going to retire within a period of less than 1 year. It is submitted that as per government's policy, where a government servant is going to retire within a period of one year, he is entitled to consideration for posting in his home district or in a place of his option. The grounds raised by the petitioner require consideration by the competent authority in view of the government's policy regarding posting of a government servant either in his home district or at place of his option, if he is going to retire within a period of one year.

It is found that the petitioner has not filed any representation but directly filed this petition before this Court.
In these circumstances, if the petitioner prefers representation within a period of 10 days from today, the same shall be considered and decided by the transferring authority/Committee within a period of four weeks from the date of receipt of representation.

For a period of five weeks, no coercive steps shall be taken against the petitioner.
