The transfer order is being challenged on the ground that the petitioner is posted as Assistant Training Officer at Bhilai whereas wife of the petitioner is posted at Dhanoura, Durg, which is a nearby station. By the impugned transfer order dated 25.7.2016, the petitioner has been transferred from

Bhilai to Dondi Lohara, District Balod, which is 200 kms. away from Bhilai. It is stated that in past, the petitioner had suffered paralysis attack and he requires regular treatment at Raipur. It will be difficult for him to seek regular treatment if he posted at Dondi Lohara, District Balod. It is also submitted that petitioner suffers from upper Limb disability also. 2.

The ground which the petitioner raised in this petition for consideration on the administrative side and not on judicial side. 3.

The petitioner has preferred a representation to the State Government on 31.7.2016, which is pending consideration. The State Government is directed to consider and decide the pending representation of the petitioner in accordance with its own policy within a period of four weeks. The petitioner may also request from the transferring authority to consider his prayer for stay.

For a period of two weeks, no coercive steps shall be taken against the petitioner.
