The transfer order is under challenge on the ground that the petitioner is going to retire shortly within thirteen months which will adversely affect calculation of his pension.

The Government Policy to consider cases where the Government servants, who are going to retire within one year, may not be applicable to the petitioner because it is more than one year. It is, however, considered that it is only one month more than one year. 3.

However, considering that the petitioner is going to retire in thirteen months, the petitioner's representation may be considered and decided by the transferring authority within a period of four weeks. 4.

The petition is accordingly disposed off.
