1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.414/2020 registered in Police Station Kasdol, District Balodabazar Bhatapara, C.G. for the offence punishable under Section 302 & 201 of the I.P.C.

3. The applicant and co-accused Ramesh Paikara have been charge sheeted for committing murder of deceased Lakhan Paikara in the afternoon of 21.06.2020.

4. As per the eye witness account of the incident stated to the Police by Humeshwari, aged about 13 years, it was the coaccused Ramesh Paikara who caused fatal assault to deceased Lakhan Paikara. At the time of incident, the present applicant was not even present at the place of occurrence. The role assigned to him is only to the extent that despite eye witness informing about the incident to this applicant, he remained quiet and did not inform the Police and thus tried to save the main accused Ramesh Paikara.

5. Learned State counsel would oppose the prayer for grant of bail.

6. Considering the nature of allegation against the present applicant, this Court is inclined to release the applicant on bail. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of ₹50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
