The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 351/2015 registered in Police Station Khamtarai, Dist: Raipur (C.G.) for offence punishable under Section 392/34 of Indian Penal Code.

As per the prosecution case complainant Ayan Pravesh on 19/09/2015 he had gone to meet his uncle by motorcycle from Baijnath Para to WRS colony between the way near WRS bogi depot four unknown persons intercepted them and looted Rs.1900/- from them. 3.

Learned counsel for the applicant submits that applicant is a student of 19 years and he has been falsely inculpated. He further submits that victim has also not supported case of the prosecution. He submits that similarly placed co-accused has been granted bail in M.Cr.C. No.7230/2015 on 22/12/2015, therefore the applicant may be released on bail.

Learned State counsel on verification do not dispute the fact that similarly placed co-accused has been granted bail in M.Cr.C. No.7230/2015 on 22/12/2015.

Considering the fact that similarly placed co-accused has been granted bail in M.Cr.C. No.7230/2015 on 22/12/2015, considering the detention of the applicant that he is in jail since 20/09/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
