We have heard the learned counsel for the Applicant and the learned Government Advocate.
2.
The direction in paragraph-4 of the judgment dated 21.7.2017, which is sought to be clarified, is to the effect that Writ Appeal No.185 of 2017 is allowed and resultantly, Writ Petition (S) No.7323 of 2009 shall be tagged alongwith Writ Petition (S) No.6440 of 2009. That direction obviously means that the Registry has to treat Writ Petition (S) No.7323 of 2009 as back to file. There can be no technical approach in the matter of reading and understanding the judicial orders.
The effect of the judgment rendered on 21.7.2017 in Writ Appeal No.185 of 2017 is that the order rendered in Writ Petition (S) No.7323 of 2009 on 1.5.2017 is vacated. This obviously means that the writ petition has to be listed for further consideration in terms of the direction contained in paragraph-4 of the judgment dated 21.7.2017 in Writ Appeal No.185 of 2017. 3.
This MCC is ordered accordingly.
