Agrawal Order On Board 20/09/2017 (1) Learned counsel appearing for the petitioner would submit that the petitioner's application under Order 9 Rule 13 of CPC for settingaside the ex-parte decree and application for stay are pending consideration before the trial Court since 27.02.2017 and therefore direction may be issued to the trial Court to decide the same expeditiously.

(2) Be that as it may, the trial Court is directed to consider and decide the petitioner's application for stay within a period of seven days and application under Order 9 Rule 13 of CPC for setting-aside the ex-parte decree be decided within a period of three months from the date of receipt of certified copy of this order. (3) With the aforesaid observation, the writ petition stands finally disposed of.
