2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.28/2020 registered at Police Station Gatapar Jangle, District Rajnandgaon (CG) for the offence punishable under Sections 376, 506 of the IPC and Section 5(tha), 6 of the Protection of

MCRC No. 5236 of 2020 Children From Sexual Offences Act, 2012.

3. The applicant has committed forcible sexual intercourse with the prosecutrix, aged about 15 years 9 months.

4. Considering the nature of allegations and the age of the prosecutrix, this Court is not inclined to release the applicant on regular bail.

5. Accordingly, the bail application is dismissed with liberty to the applicant to repeat the prayer after examination of the prosecutrix.
