The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 39/2015 registered in Police Station Raghunathnagar, District Balrampur (C.G.) for offence punishable under section 306 of Indian Penal Code.

As per the prosecution case deceased Smt. Shrimati Devi who performed marriage with the applicant on 12/04/2015 committed suicide by hanging and it is allegation that the deceased was being harrassed and tortured by the applicant, therefore she was abetted to commit suicide. 3.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case, neither applicant has abetted to committ suicide nor any instigation or harassment was made. He further submits that charge sheet is filed and reading of the evidence would not disclose the offence as has been alleged, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the statement of the witness in the case diary.

Perusal of the statement of Ramraj Pando would show that general allegations have been attributed against this applicant. Taking into account such evidence against the applicant, charge sheet having been filed, without any observation on the merit, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
