The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 54/2015 registered in Police Station Tumgaon, District Mahasamund (C.G.) for offence punishable under section 34 (2) of Chhattisgarh Excise Act.

As per the prosecution case on 6/05/2015 on a secret information received that applicant is carrying liquor in his vehicle, on raid being made 126 bulk liters of liquor was seized from the vehicle and applicant fled away from the scene.

Learned counsel for the applicant submits that seizure was not made in person from the applicant and applicant has been falsely implicated in this case, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the statement of Vishwanath Singh the owner of the vehicle wherein it is stated that vehicle was in conscious possession of this applicant. Taking into account quantity of liquor seized, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
