1. Learned counsel for the petitioner would submit that opportunity to lead the evidence and to cross-examine Panchram Suryawanshi has been closed by the trial Court. The said witness is very much necessary for just and proper disposal of the suit.

2. I have heard learned counsel appearing for the petitioner to some extent.

3. In the interest of justice, it is directed that the trial Court will issue summons for appearance of witness Panchram Suryawanshi, councilor of the ward, on 23rd October, 2017 before the trial Court for examination by special process server.

4. With the aforesaid observation, the writ petition finally stands disposed of. No cost(s).
