1. Proceedings of this matter have been taken-up through video conferencing.
2. This petition under Section 482 of the CrPC has been filed for modification of order dated 21-7-2020 passed in Cr.M.P.No.930/2020 (Atul Kumar Shrivastava v. State of Chhattisgarh) and prayer was made for deletion of 30 days time granted to the trial Magistrate to conclude the trial.
3. Heard Mr. T.K. Tiwari, learned counsel appearing for the petitioner, and considered the submission and went through the record with utmost circumspection.
4. This Court while dismissing Cr.M.P.No.2638/2019 (Atul Kumar Shrivastava v. State of Chhattisgarh) on 20-5-2020 declined to grant bail to the petitioner in exercise of power under Section 437(6) of the CrPC and directed the trial Court to conclude the trial within 45 days which
could not be concluded and at the request of the trial Court, on 21-72020, further 30 days time was granted and now, a request has been made to delete the direction containing 30 days time to conclude the trial citing personal difficulties.
5. After hearing learned counsel for the petitioner and after going through the record, particularly when the Hon'ble Supreme Court is seized of the matter, I do not consider it a fit case to modify the order dated 21-72020 passed in Cr.M.P.No.930/2020 deleting 30 days time to conclude the trial.
