The applicant has filed this Cr.M.P. followed by acquittal appeal against the judgment dated 24.02.2015 passed in Special Session Case No.30/13 passed by Special Judge under the Schedules Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, (for short 'the Act') whereby the learned trial Court acquitted the respondents for the offence under Section 294, 323/34 (two counts),& 427/34 of the IPC and under Section 3(1)(x) of the Act.

For the purpose of leave to appeal, I have perused impugned judgment, evidence adduced and copy of the charge sheet furnished.

On due consideration, this is a fit case to grant leave to appeal to the applicant. Consequently, Cr.M.P. is allowed.

Registry is directed to list this matter under the head of acquittal appeal.

The appeal is admitted for consideration.

Record of the Court below be requisitioned through usual and fax mode.

On payment of PF within seven days from now, let notice be issued to the respondents through ordinary and registered mode, returnable within four weeks. The Registry shall keep track of the delivery of the registered letter from the postal website, download the

same and place a printed copy on record after service is complete.
