Hon'ble Shri Justice P. Sam Koshy Order on Board 28.07.2021 .

1. The grievance of the petitioner in the present writ petition is in respect of rejection of the representation of the petitioner seeking reinstatement with continuity in service and also for the monetary benefits for the period that he was out of employment because of a criminal case wherein now he has been acquitted.

2. Considering the fact that the petitioner substantively is an employee under the respondent No.4 which is a Co-operative Society governed by the provisions of the Chhattisgarh Co-operative Societies Act and also considering the fact that the Co-operative Societies Act itself has a mechanism spelt out for redressal of the disputes between the employees of Co-operative Societies, it would not be proper and appropriate for this court at this juncture to entertain the writ petition when the petitioner has an alternative statutory remedy.

-23. Accordingly, reserving the right of the petitioner to avail appropriate remedy under the provisions of the Chhattisgarh Co-operative Societies Act, the present writ petition stands disposed of. Sd/- (P. Sam Koshy) Judge inder
