Hon'ble Shri Justice Chandra Bhushan Bajpai Judgment on Board 12/8/2015 (1) Challenge in this appeal is to the judgment of conviction and order of sentence dated 30.3.2012 passed by the First Additional Sessions Judge, Ambikapur, District Sarguja, Chhattisgarh in Sessions Trial No. 374 of 2010 whereby and whereunder the learned Additional Sessions Judge after holding the Appellant guilty for the offence under Sections 307 and 324 of the Indian Penal Code, 1860 (for short 'the IPC) and sentenced him to undergo rigorous imprisonment for 3 years and RI for one year alongwith fine sentence with a direction that both the substantive jail sentences shall run concurrently. (2) Learned counsel for the Appellant submits that as directed the Appellant served entire sentence and released after serving the sentence and as such the Appellant is not contesting the appeal on its merit.
-2- (3) As the Appellant is not contesting the instant appeal on its merit and even after perusal of the record of the Court below, the evidence adduced and the judgment passed by the trial Court, I do not see any illegality and impropriety in the conviction of sentence passed against the Appellant, the conviction and sentence passed by the Court below against the Appellant is hereby affirmed.
(4) As the Appellant is not contesting the instant criminal appeal on merit, it is dismissed.
