Order On Board 02/07/2015 The applicant is apprehending his arrest in connection with Crime No.59/2015 registered at Police Station - New Rajendra Nagar, Distt. - Raipur (CG) for alleged commission of offence under Section 420 of IPC.

2. Case of the prosecution is that the applicant collected Rs.10 lakhs from the complainant and his family members by assuring win of Smt. Shashi Dhritlahre, by corrupt practice, in the matter of election of Jila Panchayat, Mungeli.

3. Learned counsel for the applicant submits that as the case is of political enmity, he is being falsely implicated. He submits that he was the Observer in the election and there was neither any assurance given nor any money collected by the applicant for indulging in any corrupt practice in the matter of election.

4. On the other hand, learned counsel for the State submits that there are serious allegations and in the FIR, a very detailed report has been submitted as to how and in what manner, the total cash of Rs.10 lakhs was collected for indulging in corrupt practice.

5. Considering the material on record and that the matter relates of election and corrupt practice in the matter of election to the public office, I am not inclined to grant bail to the applicant. The application is therefore rejected. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
