This is second application filed under Section 438 Cr.P.C., for grant of anticipatory bail apprehending his arrest in connection with Crime No. 113/2014 registered at Police Station - Baradwar, District Janjgir-Champa (C.G.) for the offence punishable under Section 409, 418, 420 and 120-B/34 of I.P.C.

The first application was rejected by this Court on 25.07.2014 in M.Cr.C.(A) No. 587/2014. While rejecting the anticipatory bail application on 25.07.2012 this Court had dealt with the merit of the case
and had while refusing to grant anticipatory bail had made an observation that in event of the Applicant's surrendering himself before the Court below, his application for grant of regular bail may be considered, if possible on the same day. Subsequently it is said that the charge sheet has been submitted in the Trial Court showing the present Applicant as an absconder.

Considering the total facts and circumstances of the case, particularly taking note of the nature of the offence this Court is of the opinion that no good case has been made out for release of the present Applicant on anticipatory bail.
