Hon'ble Shri Justice Gautam Chourdiya Order on Board 05/08/2021 1) The matter is heard through Video Conferencing. 2) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 18/06/2021 in connection with Crime No. 144/2021 registered at Police Station Purani Basti, Raipur, District Raipur (C.G.) for the offence punishable under Section 34(2) of the Indian Penal Code. 3) At the outset, learned counsel for the state submits that the applicant has as many as 18 criminal antecedents out of which 09 are under the Excise Act.
4) Learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh as and when occasion arises. 5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
