Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 27/04/18 1.

This Court by its order dated 08.12.2017 had appointed Hon'ble Mr. Justice C.B. Bajpai, former Judge of this High Court as a sole arbitrator to arbitrate the dispute between the parties. Now, by memo dated 10.04.2018, the learned sole Arbitrator has expressed his unwillingness to arbitrate the matter and, therefore, the Registry has placed the matter before this Court. 2.

After having heard learned counsel for the parties and on due consideration in view of the provisions contained in Section 11(6) read with Section 15 of the Arbitration and Conciliation Act, 1996, I deem it appropriate to appoint Hon'ble Mr. Justice Dhirendra Mishra, former Judge of this High Court to arbitrate the dispute between the parties.

Registry is directed to communicate this order to Hon'ble Mr. Justice Dhirendra Mishra, former Judge of this High Court, who shall enter into reference after complying with the provisions contained in Section 12(2) of the Act of 1996 and will adjudicate the dispute expeditiously keeping in view that the matter is pending since 19.09.2017.
