The grievance of the petitioner seems to be the inaction on the part of the respondents in not taking a decision on the claim of the petitioner for grant of compassionate appointment. 2.

According to the petitioner, the husband of the petitioner late Ramdev Singh was working as a Shiksha Karmi Grade-III posted at Block Pratappur, District Surajpur, when he died in harness on 02.12.2010. On the date of death the deceased was survived by his widow the petitioner and three minor sons and a daughter. The petitioner applied for the compassionate appointment, but because the petitioner did not have the requisite educational qualification,

she was not considered for grant of appointment as an Assistant Teacher (Panchayat). However, vide letter dated 06.02.2014, the Chief Executive Officer, Janpad Panchayat, Pratappur had issued a letter to the petitioner seeking a consent for employment for any other post i.e. the post of Peon if she asked for the same. It is said that the petitioner thereafter had moved an application on 09.04.2015, however it appears that there has been no further progress on the application.

Given the aforesaid admitted factual position as it stands, the writ petition at this juncture stands disposed of directing the respondents No.2 to 4 to take an appropriate decision on the claim of the petitioner for grant of compassionate appointment on the post of Peon under the respondents in terms of the correspondence made by the Chief Executive Officer, Janpad Panchayat, Pratappur vide his correspondence dated 06.02.2014.

Let an appropriate decision in this regard be taken at the earliest preferably within a period of 90 days from the date of receipt of the copy of this order. It shall be the responsibility of the petitioner to apprise the respondents, so far as the order passed by this Court is concerned.

With the aforesaid observations, the present writ petition stands disposed of.
