Hon'ble Shri Justice Gautam Chourdiya Order on Board 13.12.2021

1. This appeal is filed under Section 374 (2) of Code of Criminal Procedure, 1973 against the judgment of conviction and order of sentence dated 03.11.2014, passed by the First Additional Sessions Judge, Surajpur, District- Surajpur (C.G.) in Session Case No. 355/2012, whereby the appellant stands convicted and sentenced under Section 493 of IPC.

2. At the outset, learned counsel appearing for the appellant submits that the sole appellant in this case has died on 15.04.2021 and there is no instruction from the legal heirs of the appellant for prosecuting this appeal.

3. Learned counsel for respondent/State upon verification confirms the fact regarding death of the appellant on 15.04.2021.

4. confirms the above submission.

5. Heard counsel for the parties.

6. From the report submitted by concerned SHO Surajpur alongwith

death certificate of appellant Ganga Ram Uike, S/o- Sodaram Uike, it is evident that he has died on 15.04.2021 and no application has been filed by the legal heirs of the deceased to prosecute this appeal. Accordingly, this appeal stands abated and is dismissed.
