(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 115/2014 registered at Police Station Batouli, Distt. Sarguja for the offences punishable under Sections 366A, 363, 368 & 376 of the Indian Penal Code & Section 3(2)(v) of the Scheduled Caste & Scheduled Tribe (Prevention of Atrocities) Act & Section 3(A)/4 of the Protection of Children from Sexual Offences Act,

2012.

(2) Taking into consideration the facts & circumstances of the and the material collected by the prosecution, particularly, taking the age of the prosecutrix, which is claimed to be 14 years by the prosecution, I am not inclined to release the applicant on bail. Therefore, the bail application is rejected.
