This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 78/2015, registered at Police Station Sarangarh, District Raigarh, C.G., for the offence punishable under Section 304(B) of I.P.C.

Case of the prosecution, in brief, is that, marriage of deceased Smt. Kaushalya Chouhan was solemnized with the present applicant in the year 2011 and Smt. Kaushalya Chouhan is said to have suffered dowry death within four years of her marriage.

After hearing learned counsel appearing for the parties; taking into consideration the nature and gravity of offence; material collected by the prosecution against the applicant and taking into account the manner, in
which, deceased is said to have died by burn injury within four years of her marriage, this Court is not inclined to release the applicant on regular bail. 4.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
