Hon'ble Shri Justice Gautam Chourdiya Order on Board 02/09/2021 1) This appeal by the accused/appellant under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 read with Section 439 of the Code of Criminal Procedure is directed against the order dated 01/07/2021 passed by the Special Sessions Judge (Atrocities), Baloda-Bazar (C.G.), refusing to allow his regular bail under Section 439 Cr.P.C. The appellant is in jail since 18/01/2021 in connection with Crime No. 07/2021 for the offence punishable under Sections 376(2)(I)(n), 450 of I.P.C. and under Section 3 (2) (v-a) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and registered at Out Post Lawan, Police Station Kasdol, District Balodabazar-Bhatapara (C.G.). 2) Neither the prosecutrix is present in person nor is there any representation on her behalf despite service of notice. 3) Learned counsel for the appellant seeks to withdraw this appeal

with liberty to file afresh as and when occasion arises. 4) Counsel for the State has no objection to the above prayer. 5) Permission granted.

6) Accordingly, the Criminal Appeal is dismissed as withdrawn with aforesaid liberty.
