1. The applicant has preferred the second bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.114/2020, registered at Police Station - Ghumka, District - Rajnandgaon (C.G.) for the offence punishable under Section 376 of the Indian Penal Code.

2. The First bail application was dismissed as withdrawn with liberty to revivie the prayer after examination of the prosecutrix on 27-08-2020 in MCRC No.3793/2020.

3. Even after the matter was called in the second round, none appeared for the applicant, therefore, in these circumstances, this Court has no other option but to dismiss the bail application for want of prosecution.
