This is second bail application under Section 439 of CrPC. For grant of regular bail to the applicant who has been arrested in connection with Crime No. 04/2015, registered at Police Station Raghunathnagar, District BalrampurRamanujganj (C.G.) for the offence punishable under Sections 341, 394 of IPC.

The earlier bail petition was dismissed on merit on 05/11/2015.

Learned counsel for the applicant submits that till today, the witnesses have not turned up.

Perusal of the order shows that the petition was dismissed on merit and no liberty was given to the applicant to repeat the bail petition, as such, I do not find it proper that within short span of two months, the repeat bail application is filed.

Accordingly, the second bail application is dismissed as no change of circumstances appears to exists. However, the trial Court is requested to expedite the trial. Sd/- (Goutam Bhaduri) Judge Kamde
