Hon'ble Shri Justice Inder Singh Uboweja Order on Board 24/07/2015 The applicant has filed this application under Section 438 of the Cr.P.C. for grant of anticipatory bail apprehending his arrest in connection crime No. 205/15 registered at Police Station Kanker, District North Baster for offence punishable under Section 376 (d) of the I.P.C.

After arguing some time, learned counsel appearing for the applicant seeks permission of this Court to withdraw the instant bail application with liberty to file a regular bail application before the competent Court on the ground that the applicant is a student of B.Pharmacy.

Permission granted. Accordingly, the instant bail application is dismissed as withdrawn with liberty as prayed for.

Now the applicant himself shall surrender before the concerned Police Station and within 15 days if he moves an application for grant of regular bail before the competent Court, the trial Court is directed to give a 3 days prior notice to the State and shall hear the application for regular bail and decide the same on the same day, if possible, keeping in view the fact that the applicant is a student of B. Pharmacy. Certified copy as per rules.
