(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 179/2015 registered at Police Station Chhuriya, Distt. Rajnandgaon (C.G.) for the offences punishable under Sections 302, 201, 376 of the Indian Penal Code and Section 3(1)(xii), 3(2) (v) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.

(2) After hearing learned counsel for the parties and taking into consideration the facts & circumstances of the case and the

manner in which applicant is alleged to have raped deceased Manisha Sidar and thereafter strangulated her and thrown her dead body into the Tank, I am not inclined the release the applicant on bail. Thus, the bail application is rejected. Sd/- (Sanjay K. Agrawal) Judge D/-
