Limited prayer is made by the learned counsel appearing on behalf of the petitioner to direct the learned Trial Court to hear and proceed with Criminal Case No.0/2014, pending before the Court of Chief Judicial Magistrate, Kondagaon, District Kondagaon between Ashutosh Pandey and V.N. Nag and others.

It is stated that the complainant has filed a complaint U/s. 200 of Cr.P.C., which was fixed for recording of evidence of the complainant on 07.08.2014 but it was not recorded and subsequently, the date was given on 18.09.2014. Frequent dates were given, however, the complainant being present in person, the statement was not recorded. Consequently, it is prayed at least the statement of the complainant be recorded irrespective of the merits of the case.

The prayer made by the petitioner appears to be reasonable, therefore, it is directed that on the next date, the complainant if appears, the learned Trial Court shall be obliged to record the evidence of the complainant and the witnesses. 4.
The direction is made without any observation on merits and the Trial Court shall be at liberty to decide the case on merits after recording the evidence.
