Order On Board 02/07/2015 The petitioner has filed this petition for issuance of a direction to respondent authorities to take appropriate steps towards closure of liquor shop on the allegation that the liquor shop has been allowed to establish and run within a distance of 100 meters from the center of National Highway.

Learned counsel for the petitioner submits that when the complaint was made that the liquor shop is operating contrary to the provisions of law, though enquiry has been ordered, till date, neither any decision has been taken nor any order has been passed.

Learned State counsel submits that the complaint of the petitioner shall be examined and appropriate decision after proper enquiry shall be taken by the competent licensing authority/District Collector Raigarh.

Considering the submission made above, at this stage, this petition is finally disposed off with a direction to respondent No.2-District Collector, Raigarh to examine the complaint, hold enquiry and pass appropriate speaking order within a period of 60 days from the date of receipt of a copy of this order. It is made clear that the respondent No.4-Licensee shall be afforded proper opportunity of hearing before passing order in accordance with law.
