This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants, who have been arrested in connection with Crime No. 170/2015, registered at Police Station Telibandha Raipur Civil and Revenue District Raipur (C.G.), for the offence punishable under Sections 457, 380, 34 of IPC. 2.

Case of the prosecution, in brief, is that, present applicants along with other co-accused persons are alleged to have stolen Aluminum Corner valued at Rs. 4 Lakhs owned by Municipal Corporation, Raipur. 3.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; recovery of said article pursuant to the memorandum of the present applicants, this Court is not inclined to release the applicants on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
