Learned counsel appearing for the petitioner submits that Rs.5,00,000/- has already been paid by the petitioner. He submits that second installment of Rs.5,00,000/- will be paid by 22.11.2017 and final installment of Rs.10,00,000/- will be paid by 28th February, 2018.

(2) In view of above submissions, counsel for the respondents would submit that if the second installment is not paid or on before 22nd November, 2017, the Bank will be at entitled to proceed further against the petitioner in accordance with the law.

(3) Prayer made by counsel for the respondent-Bank is fair and reasonable.

(4) The aforesaid statements made by the parties are taken on record.

(5) The writ petition is accordingly disposed of. E-auction proceedings, which would commence on 25.10.2017, shall not be carried out.
