1. Heard.

2. Shri Vikram Sharma, learned State counsel would submit that the subject tender in which the bid of M/s Nikhil Enterprises was accepted has been canceled by the State, therefore, the writ petition has been rendered infructuous.

3. Shri Keshav Shankar Nande, learned counsel for the petitioner would submit that the entire action commencing from the processing and award of tender is wholly arbitrary, therefore, the petition still survives.

4. In our considered view, the subject tender having been cancelled, the present writ petition has been rendered infructuous.

5. It is accordingly dismissed as having become infructuous. However, if a fresh cause of action has arisen, according to the petitioner, pursuant to the cancellation of the tender process, the petitioner would be at liberty to move afresh before this Court.
